Terms of service
TERMS OF SERVICE
OVERVIEW
These Terms of Service govern website design, hosting, website care, search engine optimization, and related services provided by McMahon Site Co. (“McMahon Site Co.,” “we,” “us,” or “our”). By requesting, approving, purchasing, or using our services, you (“the client,” “you,” or “your”) agree to these terms and to any written proposal, scope of work, or service agreement accepted for your project.
SERVICES AND PROJECT SCOPE
The standard $600 website build includes a custom-designed website of up to 5 custom pages, responsive desktop, tablet, and mobile layouts, clear page structure, professional typography and colors, benefit-focused calls to action, a contact or quote form, connection of an existing domain, launch support, and pre-launch checks of key pages, links, forms, and layouts.
Standard Terms, Privacy, and Refund or Shipping policy pages use client-approved content and are included outside the cap. Each distinct custom content page counts once; product listings and advanced shop setup are scoped separately. This pricing applies to new quotes; existing agreed scopes are honored. Each project’s final pages, deliverables, responsibilities, schedule, and price will be confirmed in writing before work begins. Work not included in the approved scope requires separate written approval and may require an additional fee.
FEES AND PAYMENT
The standard website build is $600. A $300 deposit reserves the project and authorizes work to begin. The remaining $300 is due after final approval and before the website is launched, transferred, or released for use. Each custom page above five adds $75 upfront plus $5/month after launch for expanded care. Larger, unusual, or expanded projects are quoted separately.
Invoices are due by the date shown on the invoice. McMahon Site Co. may pause work, withhold launch or transfer, or suspend nonessential services while an approved invoice remains unpaid, to the extent permitted by applicable law.
REVISIONS
The standard website build includes two organized revision rounds. The client should combine requested changes into one clear list for each round. Additional revision rounds, changes to the approved direction, or work outside the approved scope may be quoted separately and may extend the schedule.
PROJECT TIMING AND CLIENT RESPONSIBILITIES
A standard website project is targeted for completion within 2–4 weeks after the deposit, required written content, images, approvals, and account access are received. This is a good-faith target rather than a guaranteed completion date. Delayed content, feedback, approvals, access, third-party services, or scope changes may extend the schedule.
The client is responsible for providing accurate information, timely feedback, authorized access, and content or assets the client owns or has permission to use. The client is responsible for reviewing and approving all final text, images, links, pricing, claims, legal disclosures, and business information before launch.
HOSTING AND WEBSITE CARE
The base $95 monthly care plan begins after launch and covers up to five custom pages plus standard policy pages. Each additional custom page adds $5/month. The plan includes standard website hosting, up to 60 minutes of routine content updates each month, basic checks of key links and inquiry forms, a theme backup before approved changes, and email support with replies targeted within two business days. The 60-minute update allowance is shared across the whole website; additional-page fees do not increase it. Unused update time does not roll over.
New pages, redesigns, custom features, advanced development, emergency or rush work, paid apps or services, domain renewals, and SEO are not included in the care plan and may be quoted separately.
CANCELLATION AND REFUNDS
The $300 website deposit is refundable until design work begins. Once design work begins, the deposit and payments for completed work are non-refundable. If completed, approved work exceeds the deposit, the client is responsible for the remaining amount for that work as described in the written project agreement.
The monthly care plan may be canceled with 30 days’ written notice. Billing periods that have already begun are non-refundable. Any work already approved or completed before cancellation remains payable. Additional details appear in the Refund and Cancellation Policy and in the signed client agreement.
OWNERSHIP AND LICENSES
After full payment, the client receives ownership of the final project-specific website design and client-ready written content created specifically for the project, except for items identified below. The client retains ownership of the content, photographs, trademarks, and domain the client supplies or purchases.
McMahon Site Co. retains ownership of its pre-existing templates, code, tools, systems, workflows, reusable design elements, knowledge, and general methods. Third-party themes, fonts, software, images, apps, plugins, and other licensed assets remain subject to their original licenses and ownership terms. The client is responsible for ongoing third-party fees unless the written scope states otherwise.
EXCLUDED AND SEPARATELY PRICED ITEMS
Unless specifically included in the written scope, prices do not include paid apps or services, domain registration or renewal, premium themes or licenses, professional photography or video, a new logo or full brand identity, copywriting beyond the agreed scope, additional pages, major redesigns, custom integrations, advanced development, rush work, advertising, or SEO.
SEO AND RESULTS
Initial SEO setup is available for $500, and ongoing professional SEO is available for $1,500 per month. Search visibility can be influenced by competition, algorithms, the client’s industry, third-party platforms, and other factors outside McMahon Site Co.’s control. We do not guarantee search rankings, traffic, leads, revenue, or sales.
THIRD-PARTY SERVICES
The website may depend on Shopify, domain registrars, hosting providers, apps, search engines, email providers, payment processors, analytics services, or other third parties. McMahon Site Co. is not responsible for a third party’s downtime, policy changes, pricing changes, account restrictions, security incidents, or discontinued services. The client must follow each provider’s terms and maintain control of its own accounts, billing, and recovery methods.
WARRANTIES AND LIMITATIONS
Services are provided with reasonable professional care and in accordance with the written scope. Except where prohibited by law, no other warranty is made, including any promise of uninterrupted availability, error-free operation, search placement, leads, or commercial results. Nothing in these terms limits rights or remedies that cannot legally be limited.
CHANGES TO THESE TERMS
We may update these website terms to reflect changes to our services or legal requirements. The terms included in an accepted written proposal or service agreement will control that project if they conflict with a later website update.
